TERMS OF SERVICE

1.1 The present Terms of Service is a legal agreement between an end user (hereinafter: you, user, your) and Windice (hereinafter: windice, service, website, us, our, we)

1.2 The present Terms of Service (hereinafter: ToS) describe your legal rights and obligations while using the Service. If there exist a rule in the present ToS which you are not agree with, please refrain from using the Windice service.

1.3 In case we decide to amend the present ToS we may try to inform you, however it is solely the responsibility of a customer to keep updated with the recent changes and modifications made to the present ToS, and we disclaim any responsibility that may run out of the changes made to the ToS, and failure of a customer to keep updated with these changes.

2.1 Big Winnings are subject to publicity for the promotional purposes.

2.2 We reserve the exclusive right to amend, add or discontinue any part of the present ToS at any time without the advance notice given and the liability taken or laid on any party. Amendments, add-ons or Discontinuation of the clauses are in immediate effect after it has been noted (affected) to the present ToS.

2.3 We reserve the exclusive right to deny in service anyone on our sole discretion without prejudice and the advance notice.

2.4 In order to use the service, the customer must be legally free to use the service in the jurisdiction he/she accesses the services provided.

The present ToS are related only to Windice and its resources, all hyperlinks that are placed on WinDice and lead to the 3rd party sites are subject of responsibility of administration of the 3rd Party site's owners and their Terms of Service. WinDice and WinDice owners/operators/administration is not in any part responsible for the content of 3rd Party accounts and services, including those resources which links are placed and could be found on WinDice.

4.1 All services are provided on "as-is" basis, that means that no warranty or quality expectations should be applied to the service, accuracy, fitnesses of the current service. We apply every reasonable effort to make service better, and provide as good as possible stability, but despite applied measures, we do not guarantee service to be uninterrupted, error-free or defects-free that may affect your experience and expectations while using it.

4.2 There may be prohibited to use our service in different jurisdictions, however, it is up to a customer to verify whether he or she is able to use the service in their jurisdiction. 6.1 WinDice grants you a personal right, which revocable and non-transferable and non-exclusive to use the service. It is not authorized to do the following:

7.1.2 This is the customer's personal responsibility to keep login credentials(e.g. password and login) in a secure manner. Customer is officially liable for the losses occurred as a result of a 3rd party become aware of the login credentials. We strongly recommend never share the email address, password associated with your account with anyone.

7.1.3 Customer is liable for mistaken or accidental bets

7.1.4 Customer is liable for any tips sent to another customers and we do not interfere if tips were sent mistakenly.

7.1.5 Customer is responsible and liable for any bets and/or losses when bets are made from unsupported devices.

7.1.6 Customer is liable for any losses in case loan or borrowing provided within the service.

7.1.7 Customer is liable and responsible for losses in case wrong deposit or withdrawal address was used to perform deposit or withdrawal.

7.1.8 WinDice is not responsible for any losses occurred while the use of the service, and by using the site customer agrees to be liable for any of them.

7.1.9 Customer is liable and bears whole responsibility for paying taxes according to his/her local jurisdiction legislation.

7.1.10 This is solely customer's responsibility to pay for the use of Internet access services required to access the website and/or other services.

7.1.11 By using the Service, you represent the quick consent that you:

• Will fully and unrestrictedly follow the present ToS.
• Will refrain from profanity in chat, or when expressing your opinion or discussing WinDice in publicity. Will refrain from insulting any of WinDice staff, users or third parties. Should we become aware that you directly or indirectly harmed our personnel and/or reputation, we remain the right to discontinue services and either transfer you assets back or confiscate them on our own discretion, based on the caused material or any other breach to WinDice.

8.1 Those customers of legal age in their jurisdictions are eligible to use the Windice under the age criteria, as a general rule it is considered to be at least 18 full years.

8.2 Being legally capable in good mental health.

8.3 You are considered eligible if you are not restricted to use the Service by the law of your jurisdiction. We apply enormous effort to ensure that customers from restricted countries are identified and banned. We respectfully to local legislation review and ban accounts in question.

8.4 You are eligible to use account only for yourself. Should we have reasonable beliefs that multi-accounting is in practice(more then one account per IP/family/device/person), we reserve exclusive and non-revocable right to terminate account and confiscate any balance on it.

10.1 At all times login credentials must remain safe, 3rd party access to them may result in money loss, and in this case assets lost as a result of unauthorized use are not recoverable. Account is designed for personal use only.

10.2 Assets transferred to the WinDice are considered personal assets, and must not originate from any non-personal accounts (e.g. shared accounts) and addresses that are not in possession of a customer.

10.3 Customer must ensure about the actual country where s/he accesses the service.WinDice remains the right to block account should the use from the blocked jurisdiction will b revealed.

11.1 You will not use our services while located in any jurisdiction that prohibits the placing and/or accepting of bets online, and/or playing casino and/or live games including for and/or with Bitcoin or altcoins.

12.1 The present ToS breach may result in account block, or revocation of several account feature, and it depends on the severity of the breach and is done without prior notice

We may proceed with the following measures in case of small ToS breaches:

• 1. Temporary of permanently block chat access
• 2. Account suspension on definite, or indefinite time
• 3. Account closure.
• 4. Asset Confiscation and account closure in case of the breach of high severity

12.2 The breach severity determination lays in the sole discretion if Windice Administration, and customer agrees to fully and unrestrictedly agree to the WinDice decisions and not to appeal them by legal proceedings.

12.3 Account closure is resulted in lifetime prohibition for the previous account owner to use the service. Account suspension period is non-revocable, that means that suspended account is not subject to premature limitation lifting.

12.4 The owners, administration and personnel will not be liable for any changes on the service made at any time, without prior notice to you. This includes but not limited to the termination or suspension of customer's access to the service usage.

12.5 In case the balance on the account originates from faucet, and when the deposit is made to allow payout, or in cases when such scenario is abused in any other way –we reserve exclusive and non-revocable right to terminate account and confiscate any balance on it.

12.6 Should we determine any tips manipulation, that are used to payout faucet originated funds, we reserve exclusive and non-revocable right to terminate account and confiscate any balance on it.

13.1 It is strictly forbidden

• more than one account for family/ip/device/person are strictly prohibited, if we have reasonable beliefs to identify fraud, all associated accounts are subject to permanent closure and funds confiscation.
• only for earnings that come from faucet or start balance, we reserve the right to not authorize withdrawals

• known vulnerability exploits, this includes the vulnerabilities of the wallets and the site in itself
• script usage in purpose of accessing the site and gaining financial profit (e.g. bonus abuse for multiple registration)or script game access, or special features access.
• no play deposit and immediate withdrawal, or no play withdrawal after deposits
• profanity in personal messages or chat
• begging
• loans request
• buying and selling accounts, as well as account transfer
• abuse referral program by creating account under personal referral links
• spam in any possible matter (misleading, account mass creation, DDoS attacks, chat spam and etc.)

14.1 Please do not send crosschain deposits. Should there exist a crosschain deposit send (from Bitcoin cash to Bitcoin) such deposit is not going to be considered and coins will be considered lost for us.

14.2 Any subcoins such as smart contracts, or any tokens will not be accepted even if we accept the currency as a general rule, and such tokens and contracts will be considered as 'lost' for WinDice.

14.3 After we released Cryptocurrency from our wallets, we are not responsible for the frozen or confiscated coins.

14.4 The service is not responsible for network congestions during the high-volume of transactions. Please be aware that it may delay the speed of the transaction from several hours to several days, same applies to the fast transaction where higher fee is determined by the customer.

14.5 In order to maintain protection from fraud, we reserve the right to investigate the play history and hold the requested payout up to 72 hours.

14.6 We reserve the right to apply a wagering requirement of at least one time the deposit amount if we suspect the player is using Windice as a mixer.

14.7 If a user who has deposited funds on Windice refuses wagering requirement(13.6), his funds will be sent back to the address from which they come, to make sure that he/she didn't use Windice to mix the coins.

15.1 Windice reserves the right, at any time, to ask for any KYC documentation it deems necessary to determine the identity and location of a User. Windice reserves the right to restrict the Service, payment or withdrawal until identity is sufficiently determined, or for any other reason in Windice’s sole discretion. Windice also reserves the right to disclose a User’s information as appropriate to comply with legal process or as otherwise permitted by the privacy policy and by using the Service, you acknowledge and consent to the possibility of such disclosure.

15.2 All transactions may be checked in order to prevent illicit activity, including money laundering, terrorism financing, or trade sanctions violations, consistent with various jurisdictions’ laws, regulations, and norms. Windice may suspend, block or close user account and withhold funds if requested to do so in accordance with the Prevention of Money Laundering Act or on any other legal basis requested by any state authority. Enhanced due diligence may be done in respect of withdrawals of funds not used for wagering.

ENTIRELY PERMITTED BY APPLICABLE LEGISLATION, THERE COULDN'T EXIST A CASE O EVENT A WINDICE, ITS OFFICERS, DIRECTOR, EMPLOYEES OR AGENTS ARE LIABLE TO YOU OR OTHER THIRD PARTY FOR ANY DIRECT OR INDIRECT DAMAGES, THIS APPLIES ALSO TO PUNITIVE, EXEMPLARY CONSEQUENTIAL OR VIRTUALLY ANY DAMAGE THAT CAN BE DESCRIBED; THE ABOVE AND WITHOUT LIMITATION APPLIES TO: REVENUE LOSS AND INCOME, PROFIT LOSS, EMOTIONAL DISTRESS, COST OF PROVIDED OR NOT PROVIDED SERVICES OR ITS EQUIVALENT, OR VIRTUALLY ANY OTHER DAMAGE APPLIED AND SUFFERED BY YOU TO ANY THIRD PARTY AND ARISES IN CONNECTION WITH THE SERVICES OR ITS TERMINATION THEREOF FOR ANY REASON EVE IF A WINDICE ADVISED 3RD PARTIES THAT THESE DAMAGES MAY HAPPEN IN THE FUTURE.

17.1 Should there be a case where any clause of the present ToS is found by virtually any authorities in the world to be unlawful and to contradict active on the jurisdiction legislation, that occurrence in any case should not affect other clauses and paragraphs of the present ToS.

17.2 Should the situation described in 16.1 happen, the part deemed invalid and unlawful shall be substituted and amended by the correct part with the strict accordance with the applicable legislation and describe the original WinDice clause as closely as possible.

Windice reserves the exclusive right to assign and apply any of the described rights in this agreement at any time without notice, controversially the customer may not assign any obligation under the present ToS.

No separate Waiver means the waiver of other clauses listed in the present ToS.
